From advice to litigation

Liability law

Van Ittersum Advocatuur advises and represents clients in liability matters and the settlement of claims, both in and out of court.

Advice may cover matters such as the basis and extent of liability, causation, evidence, damages and recourse.

Core practice

Personal injury

The firm represents insurers, their insureds and uninsured parties at every stage of personal injury cases.

Where desired, the firm handles the entire file through to final settlement, within the arrangements agreed with the client on mandate and reporting. The interplay with policy coverage and recourse is kept in view throughout.

The firm can also take over the handling of stalled, escalated or sensitive cases. The substantive points of dispute are then reassessed, with an eye to the position of everyone involved and the scope for moving discussions forward.

Insurance law

The firm advises and litigates on questions relating to insurance contracts, such as the interpretation of policy conditions, coverage, the amount payable, double insurance, limitation and recourse.

The practice also covers insurance fraud cases. The firm assesses whether an allegation of fraud is tenable, advises on the consequences for the obligation to pay and for further claims handling, and helps weigh up any measures to be taken. Where necessary, the position is substantiated and defended, in and out of court.

Interim assignments

For interim assignments within liability and insurance practice, the firm is available as legal counsel or legal adviser, for example at an insurer, claims handling company, government body or healthcare institution. The work may consist of advising on complex files and sensitive complaints, temporarily strengthening a legal team, or carrying out or leading a legal project. The nature, duration and scope of the work are determined in consultation.

Training

The firm provides practice-oriented courses on insurance and liability law, through training institutes and in-house. Content and level are tailored to day-to-day practice and to the learning objectives of the participants.
